Terms and Conditions

These Terms and Conditions of Use (hereinafter, “Terms and Conditions”) govern access to and use of the website and simulators (hereinafter referred to as “Websites”) of LEAD KASH, as well as the terms of the credit intermediation and insurance mediation services made available and disclosed therein.

The Terms and Conditions establish the rights and obligations of the user and LEAD KASH concerning the use of the Websites and the credit intermediation and insurance mediation services provided through them.

Browsing the Websites, as well as using the credit intermediation services available on the Websites, implies the User’s acceptance of these Terms and Conditions.

USE OF THE WEBSITES

The User agrees to use the LEAD KASH Websites in compliance with applicable law, refraining from any activity that may infringe the law, morality, public order, or the rights of third parties.

By using the services provided through the Websites, the User declares that they are over 18 (eighteen) years old and have the legal capacity to enter into contracts.

The User agrees to comply with and respect the Terms and Conditions, including:

  • Refraining from entering, storing, or disseminating defamatory, obscene, offensive, xenophobic, or any other content that violates the right to privacy or intellectual property rights of third parties, as well as providing any information that may be harmful to third parties or to the owner of the Websites;
  • Not using false identities;
  • Providing their personal data, and, if applicable, the data of third parties, accurately and up-to-date so that LEAD KASH can provide the requested services;
  • Keeping their login password for the client or partner area (when applicable) secure and not disclosing it, in order to prevent third parties from accessing their account.

LEAD KASH rejects any responsibility for any delay or inability to provide the requested service due to errors or insufficiencies in the data provided by the User.

SERVICES

Description of LEAD KASH’s credit intermediation services:

  • Presentation or proposal of credit contracts to consumers;
  • Assistance to consumers by performing preparatory actions or other pre-contractual management tasks for credit contracts that have not been presented or proposed by LEAD KASH.

Description of the insurance mediation services provided by LEAD KASH partners, with data processing being the responsibility of the partner entities:

  • Presentation or proposal of life and non-life insurance contracts;
  • Assistance to consumers by performing preparatory actions or other pre-contractual management tasks for insurance contracts that have not been presented or proposed by LEAD KASH.

COMMISSIONS AND INCENTIVES

Information on the amounts received by LEAD KASH for providing housing credit intermediation services in the form of commissions and other incentives will be provided in the European Standardized Information Sheet (FINE) as required by the applicable legislation for such types of credit contracts.

PRIVACY POLICY AND COOKIES POLICY

LEAD KASH respects the privacy of the User and the protection of their personal data. Any information collected on the Websites will be kept confidential and will not be disclosed to third parties without the prior express consent of the User.

The data provided by the User will be processed exclusively to provide the requested services and improve their experience on the Websites, as outlined in the Privacy Policy and Cookies Policy.

INTELLECTUAL PROPERTY

All texts, comments, works, illustrations, artworks, and images reproduced or represented on the Websites are duly protected by copyright and are the property of LEAD KASH. Under the Copyright and Related Rights Code (CDADC), their use is only authorized for private purposes, without prejudice to more restrictive provisions within the mentioned Code. Any total or partial reproduction or representation of the Websites, or any of their elements, is strictly prohibited and may result in legal action.

The company names, trademarks, and any other distinctive signs reproduced on the Websites are protected under the applicable industrial property laws and are the property of LEAD KASH. The reproduction or representation of any part of these distinctive signs is strictly prohibited and requires prior written authorization from LEAD KASH.

COMMUNICATIONS

By using the Websites, the User expressly agrees that communication with LEAD KASH will be carried out electronically or by other means of remote communication, fulfilling the legal requirement for communications that must be in writing.

Communications will be made between the parties through the contact details provided in these Terms and Conditions at the time the contract is concluded.

Any communication will be considered received when it is posted on the Website, or 24 (twenty-four) hours after the sending of an email. To prove the sending of a communication, it is sufficient to show that the email was sent to the email address provided by the User.

RESPONSIBILITY AND EXCLUSIONS

LEAD KASH is not responsible for any damages arising from interference, interruptions, computer viruses, system failures, or disconnections that may temporarily prevent the User’s access, navigation, or the provision of services.

LEAD KASH is not a consulting service provider regarding credit contracts, as its activity is focused on presenting or proposing credit contracts and assisting consumers by performing pre-contractual management for credit contracts that have not been presented or proposed by LEAD KASH.

LEAD KASH makes every effort to ensure that the information on its Websites is accurate and up-to-date and to rectify any errors or omissions as soon as possible once they are communicated.

LEAD KASH’s simulators rely on information provided by the user, and therefore, any liability for inaccuracies, errors, omissions, incomplete or outdated information, or inaccurate data in the results presented by the simulator cannot be attributed to LEAD KASH.

In the event of discrepancies, the information provided by the institutions, financial agents, or insurance companies will prevail.

LEAD KASH is not responsible for any losses or damages arising from the inability to access the Websites or any use of the Websites beyond its control. This includes any loss of savings the user expects to make, services, business opportunities, profits, or revenues, or any loss or damage the user may suffer or incur related to the use of the Websites.

If the User requests and acquires any offer presented on the Websites, they will contact a third party who will provide the desired product or service under their own terms and conditions. It is the User’s sole responsibility to confirm that they agree with those terms and conditions before entering into a contract to acquire the product or service.

The use of any third-party website is governed by the terms and conditions and privacy policy of that website, and LEAD KASH is exempt from any liability arising from such use.

REDUÇÃO

A declaração de invalidade, ilegalidade ou ineficácia, por autoridade competente, de qualquer uma das disposições dos presentes Termos e Condições não afetará nenhuma das restantes disposições, que continuarão em pleno vigor.

COMPLAINTS

Any complaint related to the credit intermediation activity can be addressed to:

  • LEAD KASH – Send an email to info@LEADKASH.pt or in person at Avenida da República No. 45, 5.º Dto., 1050-187 Lisbon;
  • To LEAD KASH, by filling out the physical complaints book available at the headquarters or the electronic format available at livroreclamacoes.pt;
  • Directly to Banco de Portugal, by email, letter, or the form available on the Bank Client Portal at clientebancario.bportugal.pt;

Whichever channel the User chooses to present their complaint, they must include their personal details, identify the entity involved, and describe, clearly and accurately, the facts that justify the complaint.

The submission of complaints is free of charge for the User.

Banco de Portugal reviews all complaints sent to it, regardless of whether they have been submitted in the institution’s complaints book, the electronic complaints book, or sent directly to Banco de Portugal through the Bank Client Portal.

The User should direct their complaint directly to the lending entity responsible for the product or service if the complaint relates to a service acquired through the Websites.

LEAD KASH cannot respond to complaints related to the products or services of lending entities and is not responsible for any such complaints.

The User is advised to visit the website of the relevant product or service provider if they wish to file a complaint against that provider.

APPLICABLE LEGISLATION AND ALTERNATIVE DISPUTE RESOLUTION

The service contracts entered into through the Websites are governed by Portuguese law.

Any dispute arising from or related to these contracts shall be subject to the exclusive jurisdiction of the Portuguese courts.

LEAD KASH has adhered to the following Alternative Dispute Resolution (ADR) methods:

  • Lisbon Consumer Disputes Arbitration Centre;
  • National Consumer Disputes Information and Arbitration Centre.

In this regard, if services are concluded through the Websites, and in accordance with Regulation (EU) No. 524/2013 of the European Parliament and the Council of May 21, 2013, the User has the option to resolve any dispute extrajudicially through access to the online dispute resolution platform at the following electronic address: http://ec.europa.eu/consumers/odr/.
